Terms of Service

1. Acceptance of Terms

By accessing or using PlotObit's irrigation verification platform ("Service"), including our website at www.plotobit.com, dashboard, SMS notifications, USSD service, and IoT sensor network, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Service Description

PlotObit provides an irrigation verification platform that:

• Monitors water flow, pump operation, and soil moisture through IoT sensors installed on your farm
• Delivers daily SMS digests summarizing irrigation activity and crop health
• Provides a web dashboard for real-time monitoring and historical analysis
• Sends critical alerts (no-flow, low-flow, pump abnormality) via SMS
• Generates compliance scores and irrigation verification reports
• Integrates satellite-derived crop health data (NDVI) from publicly available sources

3. Account Registration

To use the Service, you must create an account by providing accurate and complete information including your name, email address, phone number, and farm location. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring the phone number registered is active and can receive SMS messages

4. Free Pilot Program

PlotObit offers a 30-day free pilot program ("Free Pilot") subject to the following conditions:

• The Free Pilot includes flow verification, daily SMS digests, basic alerts, and dashboard access
• No credit card or payment information is required for the Free Pilot
• The Free Pilot is limited to one enrollment per farm/phone number
• PlotObit reserves the right to modify or discontinue the Free Pilot at any time
• At the end of the Free Pilot, you may upgrade to a paid plan or your account will be downgraded to limited access

5. Paid Subscriptions

5.1 Pricing

Paid plans are billed monthly. Current pricing is displayed on our website. PlotObit reserves the right to change pricing with 30 days' written notice via SMS or email.

5.2 Payment

Payments are accepted via M-Pesa and other payment methods as displayed during checkout. Subscriptions auto-renew monthly unless cancelled before the renewal date.

5.3 Cancellation & Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No pro-rata refunds are provided for partial months. If you experience a service outage exceeding 48 continuous hours, you may request a credit for the affected period.

6. IoT Hardware & Sensors

• IoT sensors and gateways provided by PlotObit remain the property of PlotObit unless explicitly sold
• You are responsible for the physical safety and reasonable care of any equipment installed on your farm
• You must provide reasonable access for installation, maintenance, and removal of equipment
• Tampering with, modifying, or reverse-engineering PlotObit hardware is prohibited
• Equipment must be returned in reasonable condition upon termination of service (if provided on loan)

7. Data Ownership & Licensing

7.1 Your Data

You retain ownership of all farm data, sensor readings, and information you provide to PlotObit. You grant PlotObit a non-exclusive, worldwide license to use, process, and store your data solely for the purpose of providing and improving the Service.

7.2 Aggregated Data

PlotObit may use anonymized and aggregated data (which cannot be used to identify you or your farm) for research, analytics, and service improvement. This aggregated data may be shared with agricultural research organizations to advance farming practices in the region.

7.3 PlotObit IP

All PlotObit software, algorithms, models, dashboards, and documentation remain the intellectual property of PlotObit. These Terms do not grant you any rights to PlotObit's intellectual property beyond the right to use the Service as intended.

8. Service Availability

PlotObit aims to maintain high service availability but does not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance (we will provide advance notice where possible)
• Network or infrastructure issues beyond our control
• Force majeure events including power outages, natural disasters, or government actions
• Mobile network disruptions affecting SMS delivery

Sensor data may be temporarily delayed due to network connectivity in rural areas. Our system uses local buffering and queuing to minimize data loss during connectivity interruptions.

9. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or its underlying infrastructure
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated tools to scrape or extract data from the Service beyond permitted API usage
• Resell or redistribute the Service without written authorization from PlotObit

10. Limitation of Liability

To the maximum extent permitted by law:

• PlotObit provides the Service "as is" and "as available" without warranties of any kind, express or implied
• PlotObit is not liable for crop losses, water damage, equipment failure, or any indirect, incidental, or consequential damages arising from your use of the Service
• PlotObit's total liability for any claim arising from the Service shall not exceed the amount you paid to PlotObit in the 12 months preceding the claim
• Irrigation decisions remain your responsibility. PlotObit provides verification data, not agricultural advice

11. Termination

Either party may terminate this agreement at any time. PlotObit may suspend or terminate your account if you violate these Terms or fail to pay applicable fees. Upon termination:

• Your right to access the Service ceases immediately
• You may request export of your data within 30 days of termination
• PlotObit will delete your personal data in accordance with our Privacy Policy retention schedules
• Any loaned equipment must be returned within 14 days

12. Dispute Resolution

Any disputes arising from these Terms shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through arbitration in Nairobi, Kenya, in accordance with the Arbitration Act of Kenya. The language of arbitration shall be English.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Kenya, without regard to conflict of law principles.

14. Changes to These Terms

PlotObit may update these Terms from time to time. We will notify you of material changes via SMS or email at least 14 days before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
